1. Service Description

Back Waves Limited provides network connectivity, hosting, and related services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Service Availability & Liability

IMPORTANT: Services are provided on an "AS IS" and "AS AVAILABLE" basis.

Service Availability: We strive to maintain the highest possible service availability and network stability. However, interruptions may occur due to scheduled maintenance, upstream provider issues, or force majeure events. We do not guarantee uninterrupted service.

Data Responsibility: You are responsible for maintaining appropriate backups of your data. Back Waves Limited shall not be liable for any loss of data or corruption.

Limitation of Liability: In no event shall Back Waves Limited be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount paid by you for the Service in the one (1) month prior to the event.

3. Acceptable Use Policy (AUP)

You agree NOT to use the Service for any of the following:

  • Illegal Activities: Hosting or distributing content that violates the laws of Hong Kong or the location of the server (e.g., CSAM, copyright infringement, phishing).
  • Network Abuse: Launching DDoS attacks, port scanning, botnets, or any activity that disrupts the network integrity of Back Waves or third parties.
  • SPAM: Sending unsolicited bulk emails or hosting spam-related content.
  • Tor/VPN: Running public Tor exit nodes or open proxies without authorization is prohibited.

Violation of this AUP will result in immediate service termination without refund.

4. Billing & Refunds

  • Prepayment: Services are billed in advance. Failure to renew by the due date will result in service suspension and subsequent deletion.
  • No Refunds: All payments are final. No refunds will be issued for early cancellation, service usage, or AUP violations.
  • Price Changes: We reserve the right to adjust pricing with notice prior to the next billing cycle.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law provisions.
